TERMS: Owl Run Nursery, Inc. Terms are net 30 from the date of invoice to customers with established credit. Non-Credit customers are required to pay for their order at the time of pickup or delivery by cash, credit card, check, cashier’s check or money order. No post-dated checks will be accepted. New customers without prior credit approval will be required to provide at least a 25% deposit at the time of ordering. At our discretion, any order may be deemed COD. All accounts over 30 days from invoice date are considered due and will be charged a finance charge of 2% per month (APR 24%). All accounts over 60 days will be converted to a cash only basis. All accounts over 90 days will be turned over for collection with attorney fees, cost of collection and finance charges added to your balance. All credit customers agree to comply with these terms and agree that this contract shall be governed by Virginia State Law. Any legal action pertaining to the sale of goods from Owl Run Nursery shall be venued in whichever county is deemed most appropriate by Owl Run Nursery. Please do not hesitate to contact our accounting department if you have questions about your account.

PRICES: Prices are in US Dollars, are based on present market conditions, and are subject to change without notice. All prices are FOB place or origin. All delivery charges are COD and must be paid when stock is delivered.

TAXES: Any taxes arising from the purchase, use or resale of the goods, such as sales tax, or any other local tax, are the responsibility of the Buyer.

INSPECTION: Our nursery stock has been inspected by the Virginia and North Carolina Departments of Agriculture.

CANCELLATIONS: Cancellations will not be accepted on custom grown orders or on any B&B items that have been harvested. Any cancellation on container stock that has been pulled for shipping is subject to a 25% restocking charge. Orders cannot be cancelled after preparation for shipment. Orders may be cancelled by Owl Run Nursery due to late payments or shortage of stock.

RETURNS & CLAIMS: No plant material will be accepted for return unless it is found to be unhealthy or damaged, prior to any handling by the customer. No exceptions. Any damages in shipping must be reported at once to Owl Run Nursery and the carrier. In all cases, goods cannot be returned after they have been accepted, processed, improperly stored, planted, or otherwise treated, modified or used in any way. Complaints/Claims must be made in writing within 5 days of the invoice date. Purchaser is liable for all freight charges.

NON-GUARANTEE: We are a Wholesale Grower. All Nursery Stock is sold "as is" Without Warranty, expressed or implied.

SHIPPING & FREIGHT: All stock travels at the risk of the purchaser (customer); once the plants leave our Nursery, the customer assumes all responsibility. All shipping charges are COD and must be paid when stock is delivered. All shipments should be immediately unpacked and inspected upon arrival and promptly placed in proper storage. Any problems with the condition, quality or quantity of goods received should be brought to our attention immediately.
